The Director of the Internal Revenue Service (IRS), Carlos Marx Carrasco, announced that today it would be notify to the Exportadora Bananera Noboa the respective order that would allow the collection of a gloss of $ 85 million, which was the result of the auditioning decision made by the tax year of 2005.
The defense of the company of Álvaro Noboa (the leader of Prian) had presented two actions, one of judicial nature and an administrative to avoid the collection of IRS, since the company assures that it doesn't owes the Treasury.
However, Carrasco assured yesterday that the Second District Court Board of the Treasury of Guayaquil denied on Monday the judicial action.
Afterwards he added that the presentation of an administrative action (judicial review) exposed before the IRS, doesn't not prevent the enforcement.
The Legal Director of the Bananera, Fernando Alarcon stated on Monday that those actions detained the coercion process, by force, but yesterday Carrasco assured that this process hasn't been stopped.
Carrasco pointed out that today the payment order would be presented, this would notify the signature, and it would proceed to collect through the measures that could include seizing.
Carrasco assured that he is willing to proceed on these types of measures since his judgment could set an important precedent against the tax evasion, that currently owes the country a 45%.
The IRS began their decision process against the company of Álvaro Noboa for assuming he was evading taxes.
Carrasco added that the export company began selling through intermediaries located on financial havens; explaining that during the decision it managed to know that the economical activity declared by the bananera was made through company's related Kelson in Nassao and Pacific Fruit of Delaware.
Therefore, the official denied a prosecution as reported by the owner of the company.
Carrasco reported that although this is the second largest economic group in sales, in on the place 59 of 62 lists of tax payments.
