Fernando Alarcon, legal director of Bananera Noboa, owned by businessman Alvaro Noboa, said yesterday that the company has not declared bankruptcy and continues its normal activities, “the company is not, nor will be declared bankrupt, but will continue fighting for its rights,” said Alarcon.
PRIAN’s leader, Alvaro Noboa, is venturing into social networks like other politicians, including district authorities, Assembly Members and the head of state. A bulletin announced that Noboa has opened an account at Twitter @AlvaroNoboaP, and that he already has Facebook and YouTube accounts.

They listened the 18 minutes it took Noboa to read “What I believe,” which contains his personal and business creed. He brought it to the attention of Ecuadorians so they will join him to fight “together every day to make our dreams come true.”
Noboa does not rule out launching his next presidential bid
PRIAN leader and businessman, Alvaro Noboa, has shown himself to be in agreement with a state of emergency being declared for the banana sector due to the reduction in exports. He also referred to the freedom of speech and state powers.
Businessman and two-time candidate for President of the Republic, Álvaro Noboa Pontón, held a conference yesterday with the Press in order to discuss topics covering various areas, such as politics and business. A few weeks ago, Noboa opened an account with the social media network, Twitter.

Industria Cartonera and Banacont, property of businessman Alvaro Noboa, resumed their activities and opened their doors with losses estimated at $ 4 million, because of the seven-day suspension of their activities.
Last Monday, Bananera Continental and Industria Cartonera Ecuatoriana, both property of Noboa, were forced to close their doors by the IRS, according to that agency, for failing to submit declarations on income tax.
Only Industria Cartonera, managed by Leonardo Noboa, stopped producing 600,000 boxes during the suspension. Meanwhile, Bananera Noboa would have ceased to expoert 200,000 boxes.
Banacont is the largest exporter of bananas in the Group, each week over 500 thousand boxes are shipped. According to the Association of Banana Exporters of Ecuador, in March, 27.9 million boxes were sold abroad, especially to the European Union and the United States, out of which 2.1 million were from Banacont. The damage, according to the company's legal adviser, Douglas Romero, is not only for the businesses but also for the Treasury, because of the taxes that aren’t paid.
Alvaro Noboa personally inspected the reopening of Industria Cartonera, where he arrived just after 14:00.
Noboa greeted his staff and toured the factory.
Later, he thanked among the media there and encouraged the work, and said that both Industria Cartonera and Banacont are up to date on the payments to the IRS and they fulfill the labor rights of his employees. He also highlighted he performs a successful business program.
“This political persecution has to end” said former presidential candidate and leader of Prian referring to the closures to which their companies have been subjected since Rafael Correa won the presidency in 2007. (NMCH)
It is not the first time
Banacont began operations last year, after the IRS shut down the Bananera Noboa by a tax dispute which requires payment of more than $ 80 million in income tax. Molinera, El Café, and Molinos Poultier are other group companies which are under the scrutiny of the tax agency. The last closure was the fourth facing companies linked to the corporate group since 2007. The IRS has denied that it is a political persecution.

Yesterday, the Internal Revenue Service (IRS) lifted the sanction on Bananera Continental Banacont S.A. and Industria Cartonera Ecuadoriana S.A., companies related to Grupo Noboa, which were closed on May 30th because of failing to file on time their declaration of Income Tax of 2010.
Alvaro Noboa, a shareholder in both companies, said the closure of firms caused $ 5 million in losses during the seven days of closure: Banacont lost $ 4 million and Industrial Cartonera lost $ 1 million.
He said the penalty also affected banana production and agricultural workers and their families, who stopped receiving their wages, as well as carriers and others involved in the banana business.
Noboa walked through Industrial Cartonera Noboa to verify the operation of the plant, which restarted operations from 08:00 am.
He also referred to the gap that the Government has caused by increasing Public Spending and that, in order to cover it, taxes of all kinds have been created, not only for the upper class, but also for the middle class.
Noboa affirmed that the country lacks of foreign investment because there is no security for it, and therefore productivity is being seriously affected by it.
Banacont and Industria Cartonera Ecuatoriana resumed their operations yesterday. After seven days of being shut down by the Internal Revenue Service (IRS), the employees returned to their activities.
The first activities of the day included cleaning yards, reviewing and rescheduling of production machinery in Cartonera and Banacont.
Both companies are part of the business group of Alvaro Noboa, who was present yesterday afternoon at Cartonera to greet workers and criticize the actions taken by the IRS. "This was a political persecution, but we continue to work. I thank all my co-workers who continue working today."
According to the IRS, the two companies did not present claims for payment of Income Tax 2010 on time.
Noboa also criticized the proposal to raise the cost of basic services, such as the raise on Light Service to the Industry Sector, while public spending keeps on growing. "Government advertising is the only concern, while there is no support to the productive area. It’s impossible to live artificially”, he added.
Leonardo Noboa, Manager at Cartonera, affirmed that closing the plant generated a loss of $ 1 million since more than 600,000 banana boxes were not shipped. “Employees could not work but they still have to get paid, along with basic services and taxes to the IRS."
More than 420 people work at Cartonera, and they focus on the production of cardboard boxes for banana and other fruits.
The Banana exporting company, Banacont, reduced their sales by 30%, which equals 200,000 boxes, since the fruit could not be placed into the boxes.
The resolution of the Internal Revenue Service (IRS) of closing Industria Cartonera and Banacont for seven days due to not declaring their Income Taxes of 2010, caused problems on the shipping and production of comercial cardboard boxes.
The 30% of the fruit that Banacont exports every week is lost. This means that 200,000 boxes of banano were not sold and were not shipped last week.
Also, the company is going to have to compensate their clients on the United States and the European Union who expect the fruit on the next days. But, in this scenario, there will be delays.
Only starting today, both Banacont and Industria Cartonera – which are both part of Alvaro Noboa’s business group- will be able to operate.
Bernardo Manzano, Production Manager of one of the estates in Los Rios Province, affirmed that in just 3 days, around 30% of the fruit was lost because it could not be cut and shipped. “Grupo Noboa (Noboa Group) exports nearly 600,000 boxes weekly, out of which 200,000 are lost now. And now the harvest of next week needs to be taken care of.”
According to Manzano, it is not easy to get ships from other companies to put their fruit on, since they need room for it and there wasn’t any. “The fruit is perishable and if the deadline is passed, it ripens very quickly”.
Meanwhile, the Leader of Grupo Noboa affirmed he is just another worker of the companies, and that his accounts are clean and he owes nothing. “There is a Class Struggle in our country just like the one in Venezuela, Cuba, Bolivia, all of which lay down in the bottom of the world. We have the right to work.”
Douglas Romero, attorney of the companies, stressed it was a measure of Poitical Persecution against the companies of the group, since the taxes were declared on time, but the companies were still closed. “I do not think that out of 200 special taxpayers, only 2 have not presented their declarations and get closed with the presence of the Military and the Police.”
According to Romero, the IRS loses more than what the company does because of the closing. “They will not receive the taxes that come from the transactions from transporters, ships and sales the fruit generates in the market.”
Banacont is the main banana exporter of the group, and as of March, 2011 it was the 4th Best Selling Banana Company of Ecuador. According to records of the Banana Exporters Association of Ecuador, 27,9 Million boxes were shipped last March, out of which 2,1 Million were from Banacont.
On top of the list there is Ubesa, and next to it there are another Exporting companies such as Pacific Crown Fruit and Reybanpac. Banacont just started their operations on 2010, after the IRS shut down Bananera Noboa because of a tax dispute in which more than $80 Million were demanded from the Company for Income Taxes.
The companies, Banacont and Industrial Cantonera, are up to date on their payments and have paid all of their taxes, both companies are part of the White List of th IRS, which means they are up to date in all of their tax obligations.
However, after requesting an extensión in a timely manner, and after Banacont and Industria Cartonera filed their taxes on May 26th,, 2011, the IRS arbitrarily closed them on May 30th, 2011, for 7 days, with a very clear political motivation.
Sales go down $4 Million

Businessman Álvaro Noboa, saying he was just one more worker of his companies, protested outside the Internal Revenue Service (IRS) Headquarters in Guayaquil, along with 300 workers.
Noboa asked for the opening of Bananera Continental and Industria Cartonera Ecuatoriana, which had been close for 5 days yesterday.
Last Monday, these companies were forced to close their doors. It was the fourth time in which companies related to Noboa have been closed by the IRS since 2007,when Rafael Correa got to Carondelet.
Noboa arrived to the protest after 14h15, wearing black. Not long after he cameo ut, he asked to greet his fellow co-workers: employees from Banacont, Cartonera and other companies of the Group. He said the closing was not fair, he spoke about Political Persecution, and affirmed that his companies are up-to-date on the Payment of Taxes. Until now, it has been known that the closing of the companies mans $4 million less in exportations

Banacont and Cartonera Ecuatoriana, companies connected to businessman Álvaro Noboa Pontón, and that were closed last Monday by the Internal Revenue Service (IRS), will start their engines again.
This is our last day of protest because tomorrow we get to the seven days of closing” said Douglas Romero, Attorney of Grupo Noboa, during the third day (yesterday) of the protest.
He said it was worthless that even the families of the agriculural men got to the protest to ask they let them work. To them, the damage affects them for two weeks, because they will not have fruit until the third week.
Álvaro Noboa, former Presidental Candidate also atended to show his support for the request the workers did on May 31st. But he also spoke about his intentions. “My misión is still the same: a new Ecuador, productive and where there is a big unión between the Government, businesmen, and workers” he said.
“We have a right to work, but in order for that to happen, the conditions from the government have to be fulfilled” said Noboa.
The owner of the Bananera of the same name, spoke against the closing of his two companies, saying that the companies appear on the Website of the IRS among those who are up-to-date on their obligations. The Tax Administration said they had not cancelled the Income Tax of 2010, and therefore they closed both companies.
“Ever since 1998 they have tried to damage my image over and over again. However, to feel the support of the Ecuadorians is very gratifying. We have proved with facts that Alvaro Noboa is a man who loves Ecuador. He is the private businessman who generates the more work for people” said the former Presidential Candidate.
Noboa said about the two years left the Government of Rafael Correa has. “It is good for him that the next President of Ecuador is Alvaro Noboa, because any other Candidate only wants something bad for the Country. I want to take my country to the top of the world.”

Workers, businessmen and Government, all of them have to learn to work together to be able to solve the problems of a country, instead of the fight of social classes Government is encouraging, the Government has failed in that fight, they lost the last referéndum, and here we are, together with the workers and me in one single body.
We are in one single body as a whole, telling the country we want to work, we want the companies to be reopened, telling them the companies have been closed unfairly, telling them we want to keep on being the biggest producers of this country, and join all the Ecuadorians, to a new Ecuador, where businessmen, executives, employees, everyone become just co-workers and hopefully this also becomes a mission to transform Ecuador, and the Government, whose only activity up to now has been shattering half of Ecuador, and, therefore, the half of the Ecuadorians said no in the last referendum.

Protest. Francisco Garrido, worker of Clementina Estate, said he disagreed with the position taken by the IRS.
The closing of two companies of businessman Alvaro Noboa Ponton, which, according to reports from the Internal Revenue Service (IRS), did not declare on time their Income Taxes of 2010, caused producers and independent Banano Sellers to request a meeting Yesterday with Juan Miguel Avilés, the IRS Director, to inform him of the economic damage because of not working for 7 days.
“The loss is nearly 600,000 boxes that are out of production. It is an impact of more than $ 1M. This number covers everything, it includes the sellers of the twine, the glue or the ink. It is a ripple effect. There is also the risk of losing clients because of not delivering the fruit” says Leonardo Noboa, General Manager at Cartonera.
While more than 30 workers of Clementina State in Babahoyo were screaming “let us work”, Douglas Romero, Attorney of Grupo Noboa, along with four Banana Producers, met with Avilés.
“We ask the authorities to let us do our job. We live from this job. I am paralyzed for seven days, that means today I am going to lose more than 80 dollars. If an agreement is not reached, we will come tomorrow, more than 3,000 people, to ask for the reopening of the company” protested Reinaldo Bejarano, worker of the Estate.
After the meeting with Avilés, Romero comunicated that the companies will remain closed. “The IRS persists on their stubborn position of not removing the sanction, which is no legal. The effect is of two weeks. The loss, just for Banacont, will be of $8,000 Million”, he revealed. Avilés insisted on the fact that none of the two companies declared on time, therefore he will not give the order of reopening.
Grupo Noboa (Noboa Group) calculates that their company, Banacont S.A., will stop billing $4 million on the seven days of closure sanctioned by the IRS last Monday.
The Attorney of the companies of the Group, Douglas Romero, said that besides the economic damage, the closure affects the Banana production and “thousands of Agricultural workers and their families who will stop receiving their income; hundreds of producers who will not have stock to deliver their fruit; the transporters who will not have income for the fruit.”
A Group of producers and sellers connected to Banacont and Industrial Cartonera Ecuatoriana (of the same Group and also cancelled) asked yesterday for a meeting with the Southern Regional Director of the IRS, Juan Miguel Avilés, to talk about the problems generated in the delivery of their products.
The two firms are closed because of not declaring on time their Income Tax of 2010. Romero explained that on May 24th, they asked for an extension on their declaration deadline, which was denied on May 27th, a day after the order of closure was released. “Therefore we clearly assume there has been an irregularity in the process,” he affirmed.
He also stressed that on the night of May 26th, the two companies sent their declarations via Internet to the IRS, and affirmed that on May 23rd they were notified with orders of presumptive tax assessment to calculate the income tax of 2010, which he considered an unusual situation in the country.

Measure. According to declarations of the IRS Director, Juan Manuel Avil´s, Banacont and Cartonera will not be able to do economic activities during the next seven days.
Grupo Noboa affirms that the two companies shut down by the Internal Revenue Service (IRS) because of not declaring their Income Tax of 2010, will suffer very strong economic losses.
“Because of the seven days of closure, only Banacont will stop billing $4 Million. We have not count yet the losses of Cartonera. But it is not fair because we did present the declaration” said the Attorney of the companies, Douglas Romero.
The Executive adds that the impact will extend to the proccess of fruit production. “It affects thousands of agricultural workers and their families who will stop receiving their salaries. It also affects producers, since they will not have stock available to deliver fruit, and transporters, who will not have the income generated by the transportation of Banana”.
According to documents of Romero, the dates of declarations given by Juan Manuel Avilés, IRS Director, do not match. “Banacont and Industrial Cartonera presented to the IRS, back in May 24th, an extension request, and on May 26th, the order of closure was launched. But the refusal of the IRS to the extensión request is date don the 27th. There is a very clear iregularity in the process,” says Romero, who also added that the State also gets affected since they will not be receiving the taxes that might have been generated if the companies were still operating these days.
However, Avilés said that the process of closing is supported by the Law. “Despite of notifying both companies on May 10th, so they could submit their Tax Declaration, they did not do it.”
Now, his main Banana Business is paralyzed, he can’t sell the fruit and can’t ship them in the exporting boxes from the Seaport of Guayaquil.
Last Monday, the Internal Revenue Service (IRS) closed two companies located on Southern Guayaquil, because they did not present their payment declarations on their Income Tax from last year.
Douglas Romero, Attorney of the companies of the Noboa Group, affirmed that the damage caused by the closure, only for Banacont, is over $4 million in a week. “The damage extends also to production, since thousands of farm workers and their families will be affected because they will stop receiving their payment. There will be producers who will not have enough stock to deliver the fruit.”
Romero said that the IRS will also be affected with the closure because taxes will not be generated, since the companies are paralyzed.
Yesterday, the attorneys of Banacont and Cartonera tried to cancel the Closure. Eduardo Acosta, Attorney of the Group, said that all the Tax documentation and the Tax Declarations of 2010 had already been delivered to the IRS. “The closure was illegal and we ask to be allowed to reopen the doors of the companies.” Banacont is the fourth Banana Exporter of Ecuador.
Former presidential candidate, Alvaro Noboa, questioned the exit poll results published by Rafael Correa’s government the moment the voting ended. “Every fraud stems from bad surveys and the surveys said that he was winning… It’s known that there’s been fraud in Ecuador before and there’s fraud again.”
Nevertheless, he announced he was in favor of not only looking for a majority, but also “working in consensus together with the people of the left, with people of the right and people of the center…”
He recalled that “only three years ago we created a new Constitution and now we want to reform it. Those (issues) could have been easily dealt with on the Assembly level. You don’t take the country forward with a majority, you take it forward with everybody.”

Today at a press conference, Alvaro Noboa spoke to the Ecuadorian people which are close to take part of a referendum on May 7th.
He stated that “the country doesn’t belong to Alianza País Party; the country doesn’t belong to the country; the country belongs to Correa.” Noboa stressed that the President has fought with supporters of Alianza País, Pachacutick, MPD, among others. With those who he would do the citizen’s revolution.

In the referendum that is to take place this weekend, my vote is “No”, because I, like all Ecuadorians, am sick of the arrogance. Furthermore, I think that this election is not a democratic election because we have an Electoral Tribunal that clearly adheres to the Regime, that has declared the Chief of State to be its political subject, and which is campaigning openly. I also think that this vote is not democratic because there is great control over the Ecuadorian press, and that is very bad, because the press always has to be independent. I vote “No” in the rejection of evil. Thank you very much.

Today at a press conference, Ab. Alvaro Noboa gave his personal point of view about the next Ecuadorian referendum to be held on May 7.
Noboa stressed that ”this election is not a democratic election because we have an Electoral Council that is clearly attached to the Regime, which declared the Head of State as a political entity and he is in an open campaign.”

The forum, Cauce Democrático (Democratic Channel) and former presidential candidate for the Prian, Álvaro Noboa, hold out hope for a triumph for “No” in the referendum next Saturday, but they are concerned about the actions of the electoral organization during the process.

The social help that Atty. Alvaro Noboa gives day after day to Ecuador is reflected on the different areas where he contributes. Each day, at the Customs of Guayaquil, the main ecuadorian port, tons of shipments arrive with many different purposes: trade, commerce, medicines and general commodities. Once a year, however, a container arrives with hope for those who are in need. The sender is Guayas-Ecuador Hilfe e.v, a German organization that, for several years, has counted with the financial aid of Atty. Alvaro Noboa for the transportation of those containers that provide help to different organizations around the country.
On December, 2010, Alvaro Noboa delivered 100 Short hundredweight of “Lista” flour to the Embassy of Panama to help the victims of that country.
The heavy rains that lash Panama have affected 13.400 people, the worst affected areas are the provinces of Colón, Darién, Panama and the Caribbean region’s indigenous Kuna Yala. The country considers these rains as one of the worst disasters in the recent 100 years of the country. In addition, the areas that did not were hit directly by rainfall also have been affected by shortage of drinking water, food, and electricity cut off.

They want to charge Bananera Noboa $90 million dollars in taxes for 2005, while, according to the attached chart, larger companies than Bananera Noboa, such as Chiquita, Dole, del Monte, have been taxed, on average, $250,000 with profits of around more than one million dollars each.
